In re Univ. of San Diego Tuition & Fee COVID Refund Litigation

A settlement has been reached in a lawsuit involving the University of San Diego (USD). The lawsuit claims that students should receive partial refunds for tuition and fees from the Spring 2020 semester because USD switched to online classes in March 2020 due to the COVID-19 pandemic. USD denies any wrongdoing, but the court has given preliminary approval for the settlement.

Who is included?

You are part of the settlement if:

• - You were enrolled at USD during Spring 2020, and
• - You paid any tuition or fees (not covered entirely by a USD scholarship or grant), and
• - You haven’t already been fully refunded.

You are not included if you opt out, received a full USD scholarship, or didn’t have to pay tuition or fees for that semester.

What does the settlement provide?

USD will pay $1.4 million into a fund. Some of this will go toward legal fees, service awards, and settlement administration. The rest will be divided among eligible students.

How do you get your payment?

You don’t need to do anything to receive your share. If the court approves the settlement, your payment will be mailed to your last known address.
